Terms of Service

1. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Accounts and security

Some features require sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly if you suspect unauthorized access, misuse, or any other security issue involving your account.

3. Fitness and health disclaimer

FitzyGo is a fitness, planning, and tracking tool. It is not a medical device, not a substitute for professional medical advice, diagnosis, or treatment, and not a guarantee of any particular result. You should consult a qualified physician or health professional before starting or changing any exercise, nutrition, or training program, especially if you are pregnant, injured, have a medical condition, or have any concerns about physical activity.

You are solely responsible for your health, training decisions, exercise form, equipment use, environment, and the intensity and safety of any workout you perform. Stop exercising immediately if you feel pain, dizziness, faintness, shortness of breath, or other concerning symptoms.

4. Photo, camera, and media access

The Services may request access to photos or media so you can upload progress images and related content. Any permission you grant is limited to the features you choose to use. You are responsible for making sure you have the right to upload any image or other media you submit.

5. License to use the Services

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the Services for your own lawful personal fitness purposes. We reserve all rights not expressly granted to you.

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Services, except where applicable law expressly permits it.

6. User content

You may submit content through the Services, including workout inputs, progress photos, text prompts, messages, exercise logs, measurements, and other materials you choose to provide ("User Content"). You keep ownership of your User Content.

By submitting User Content, you grant FitzyGo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, adapt, translate, display, and use that content as reasonably necessary to operate, improve, secure, and support the Services, including generating responses, recommendations, analytics, and other features you request.

You represent and warrant that you have all rights, permissions, and consents needed to provide your User Content and that it does not infringe, misappropriate, or violate any law or any third-party rights.

7. AI and automated output

FitzyGo may provide AI-generated plans, suggestions, exercise guidance, summaries, and other automated outputs. These outputs are offered for informational and educational purposes only. They may be inaccurate, incomplete, out of date, or unsuitable for your personal circumstances.

You must independently evaluate any output before relying on it. FitzyGo does not guarantee that any recommendation will be safe, effective, or appropriate for you, and we are not responsible for any injury, loss, or damage resulting from your reliance on such output.

8. Subscriptions

The Services may offer optional auto-renewable subscriptions and other paid features. Pricing, feature access, and eligibility are shown in the App and in the Apple purchase flow at the time of purchase.

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your Apple ID account settings.

Refunds are handled by Apple in accordance with Apple's policies and applicable law.

9. Acceptable use

You agree not to misuse the Services. For example, you must not:

• Use the Services for unlawful, harmful, or fraudulent activity.
• Upload content that is abusive, defamatory, obscene, harassing, hateful, threatening, or otherwise objectionable.
• Upload content that infringes intellectual property rights, privacy rights, publicity rights, or any other rights of another person or entity.
• Attempt to bypass, disable, scrape, interfere with, or reverse engineer any part of the Services, including security, billing, or rate limiting controls.
• Use automated means, bots, or unauthorized scripts to access the Services or collect data from them.
• Introduce malware, spam, phishing content, or other harmful code.
• Misrepresent your identity or otherwise impersonate another person.

10. Intellectual property

The Services, including all software, designs, text, graphics, logos, trademarks, and other materials we provide, are owned by us or our licensors and are protected by intellectual property and other laws. Except for the limited license granted in these Terms, no right, title, or interest in the Services is transferred to you.

You may not use FitzyGo's name, branding, or logos without our prior written permission.

11. Session storage and retention

We may retain session data, saved workouts, progress records, and related content for up to 3 months after your account becomes inactive or unsubscribed, or for a longer period if needed to comply with law, resolve disputes, enforce our agreements, or protect the Services. We may also delete data earlier if it is no longer needed for the Services.

12. Third-party services

The Services may rely on or link to third-party services, including payment processing, analytics, advertising networks such as Google AdMob, app stores, device features, and content providers. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies.

Advertising partners may automatically collect or receive certain information from your device or the Services to deliver, measure, and improve ads. Any such collection is controlled by the relevant third-party provider and your device privacy settings.

13. Suspension and termination

We may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us, interfered with the Services, or used the Services in a way that could harm us, other users, or third parties. You may stop using the Services at any time.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non- infringement, accuracy, or availability.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any workout, plan, recommendation, or tracking result will meet your needs or produce any specific outcome.

15. Limitation of liability

To the maximum extent permitted by law, FitzyGo and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the Services.

To the extent liability cannot be excluded, our total liability for any claim relating to the Services will be limited to the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or the minimum amount permitted by law, whichever is greater.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may provide notice within the App or by other reasonable means. Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.
